Privacy Policy — OurKidsWin! and EdNets

Protecting your privacy is important to us. We hope the following statement will help you understand how EdTech Networks, Inc. (“EdNets”) collects, uses and safeguards the personal information you provide to us through EdNets.com, the School Websites or various EdNets Programs to manage school communications (the “School Program”), and through www.ourkidswin.com or related programs to participate in the school fundraising program OurKidsWin! (“OKW”) The School Program and OurKidsWin! are referred to collectively as the “Programs”.

Information EdNets Collects from You

EdNets provides schools with web-based communications technology (including but not limited to Websites and e-mail, and referred to collectively as the “Communication Technologies”) and collects information from you to manage access to student information and/or for school communication (collectively the “School Communication”) and to operate OurKidsWin! (the “OKW Information”).

A “User” is a person who has registered with EdNets for School Communications as well as general communications from OKW but has not registered one or more credit, debit or loyalty cards to participate in OKW.

A “Member” is a person who has registered with EdNets for School Communication and has registered one or more credit, debit or loyalty cards to participate in OKW.

Users and School Communication. People desiring School Communication must register with EdNets. Registration information will include name, address, zip code, school/school district, age and e-mail address, and such additional information as deemed appropriate to authenticate a User, to conduct School Communication and undertake such functions as determined appropriate by a school or school district. Information provided as a User may be shared with the school/school district designated by the User. When you voluntarily register with EdNets as a User, you will be requested, but not required, to provide additional personal information (communication preferences, interests, student related information) that helps EdNets conduct School Communication efficiently and to serve content of interest to you.

A parent need not become a “Member” in order to have access to School Communication.

Members and OKW. OKW allows EdNets to raise money in support of local schools. If you desire to participate fully in OKW, you must register credit, debit and/or loyalty card information (each a “Registered Card”), and to designate a participating school district to receive rebates from purchases you make in connection with OKW. EdNets uses this information to identify transactions that qualify for a rebate and to report rebate activity to appropriate parties.

For all Programs. For all Programs, EdNets may also collect information about your computer hardware and software. This information can include your IP (Internet Protocol) address, browser type, ISP (Internet Service Provider), referring/exit pages, platform type, date/time stamp, and # of clicks, domain names, access times, referring website addresses, and actions (e.g. open, read or click through) to e-mails or other electronic communications. EdNets uses this information to administer the Programs, to detect problems with our hardware and software and conduct associated technical support and service, to maintain the quality of the Programs, and to track traffic patterns and response rates through the Communications Technologies.

Your Profile

Information you provide to EdNets shall be maintained in a web-accessible, secure profile (the “Profile”), which you may elect to administer.

Ownership of Information

EdNets is the sole collector and owner of information collected through the Programs. When you link to another website through the Communications Technologies, EdNets does not collect or own the information collected on those websites. You should review the privacy policies of the operators of those websites.

How We Use Your Information

EdNets uses personally identifiable information to operate the Programs, to encourage registration as a Member, and to provide Users and Members with information about OKW news, and offers and discounts from merchants participating in OKW (the “Merchants”). EdNets offers a series of opt-out options, depending on the applicable Communication Technology, to Users and Members who do not wish to receive such messages. On rare occasion, it is necessary to send out a service related announcement. For instance, if our service is temporarily suspended for maintenance, then EdNets may send you an e-mail. However, these announcements will not be promotional in nature.

Our Privacy Guarantee

EdNets does not sell, lease, rent or give any personally identifiable information provided by you, as either a User or Member, to any third parties, except as specifically disclosed in this Privacy Policy. EdNets will not voluntarily enter any agreements which require disclosure of personally identifiable information as a condition of such agreement.

EdNets may disclose your personally identifiable information: (1) to third parties that are directly involved in operating or supporting the Programs, in which case, such third parties shall be prohibited from using or sharing your personally identifiable information except to the extent necessary to operate the Programs under terms of agreement with EdNets, which agreement shall require the third party to maintain the confidentiality of your information; (2) under terms which maintain the confidentiality of your information, to third parties to the extent reasonably necessary: (a) to correct technical problems and malfunctions with the Communications Technologies and to technically process your information; (b) to protect and defend the rights or property of EdNets; or (c) to protect and defend the personal safety of users of the Communications Technologies; (3) to participating school districts but only the extent of User Information, or user names of those Members that have designated the school district as the recipient of rebates in connection with OKW in order to audit OKW results, or (4) to conform to the edicts of the law or comply with legal process served on EdNets..

EdNets may share non-personal, summary, or aggregate data (the “Aggregate Data”) with Merchants and other third parties, provided that all personal identifying information is removed and the Aggregate Data or format of presentation does not enable personal identification of you.

Cookies

EdNets uses persistent cookies to deliver content specific to your needs and interests. A cookie is a text file, which indicates your EdNets User Name or Member Number. We use this cookie to (a) identify Users and Members so that you may receive a start page more optimized for Users and Members than for new or unregistered users of Communications Technologies, or (b) to maintain session information to prevent the need for logged-in Users or Members to re-enter login information when browsing outside of the Websites. You do not have to have cookies enabled on your browser to use the Communication Technologies. A cookie cannot read information off your hard drive or read cookie files from other websites.

Log Files

EdNets maintains log files. This includes IP (internet protocol) addresses, browser types, ISP (Internet Service Provider), referring/exit pages, platform type, date/time stamp, and number of clicks to analyze trends, administer the site, track user’s movement in the aggregate, and gather broad demographic information. IP addresses, etc. are not linked to personally identifiable information. (IP addresses are tied to personally identifiable information to enable our web-based service).

Security

At EdNets, protecting your personal information is important to us. That is why we employ state of the art technology to safeguard your information. All data relating to secure transactions or personal identifying information (e.g. Profile etc.) is encrypted for transmission on the internet using Secure Socket Layer (“SSL”) technology. Encryption involves systematic scrambling of numbers and letters so that if a person intercepted a packet of data during transmission, then the person would not be able to use the data. Our database servers storing personal identifying information are “secure” servers and protected from outside access by a series of firewalls and other state of the art security measures. EdNets continually monitors for vulnerability, unauthorized intrusion and unauthorized activity.

With respect to OKW, EdNets complies with Payment Card Industry Data Security Standard applicable to the collection and storage of credit card information.

Links to Other Websites

EdNets provides links through the Communications Technologies to the websites of Merchants. EdNets does not operate or maintain such Merchants’ websites, and EdNets does not have access to such Merchants’ servers. EdNets is not responsible for the processing of any transactions or orders conducted on such Merchants’ websites, nor will EdNets be responsible for the content or privacy practices of such Merchants. If you have any questions regarding the content or privacy practices of such Merchants, please review their respective privacy policies or contact them directly. OurKidsWin!

OKW enables Members to direct rebates to schools/school districts by registering a Member’s VISA, MasterCard, Discover, or American Express credit cards, selected debit cards, or certain Merchant loyalty cards (collectively the "Registered Cards") with EdNets. When a Member purchases from a Merchant 1) in-store using a Registered Card, or 2) on-line with the transaction originating at the On-Line Mall on a School Website or at OurKidsWin.com, EdNets can track the transaction and recover a rebate for the benefit of the designated school/school district. Participation in OKW is voluntary. Those Members that voluntarily choose to participate in OKW will be asked to provide certain Registered Card information and additional personal information to EdNets. Such Registered Card information shall be protected under all of the applicable provisions set forth above. All Registered Card numbers are stored in encrypted format in a secure database. EdNets does not retain a plain text file of Registered Card information.

Changing or Removing Information

If you would like to change any information you have provided to us, or have information removed from our database, you may do so in your Profile or you may contact the EdNets Member/Merchant Services Team.

Compliance with Laws

EdNets complies with applicable federal and state laws and regulations relating to the privacy and security of student records and information.

Questions Regarding Our Privacy Policy

If you have any questions concerning this Privacy Policy, please send an e-mail to privacy@EdNets.com.

We reserve the right to make changes to this Privacy Policy at any time. Visitors to the Websites may review the Privacy Policy at any time. If we are going to use your personally identifiable information in a manner different from that stated at the time of collection, we will notify you via e-mail. You will have a choice as to whether or not we use your information in this different manner. However, if you have opted out of all communication with EdNets by deleting or deactivating your account, or by failing to maintain an active e-mail address in your Profile, you will not be contacted, and your personal information will not be used in this new manner. In addition, if we make any material changes in our privacy practices that do not affect user information already stored in our database, we will post a prominent notice on our website notifying Users and Members of the change. In some cases where we post a notice, we will also e-mail Users and Members who have opted to receive communications from us notifying them of the changes in our privacy practices.
